Ahoy Days Charter Terms & Conditions (Australia)

1. Definitions

  • Ahoy Days: Ahoy Days Pty Ltd (ABN 23 625 946 474), the facilitator of yacht charters.
  • Charterer: The person or entity booking the charter.
  • Charterer's Group: All guests aboard.
  • Operator: The yacht owner or manager providing the vessel.
  • Vessel: The specific yacht confirmed in a booking.
  • Master: The qualified captain in command.

2. Quotations

All quotes remain valid for 48 hours, unless otherwise specified, and may require reconfirmation by the Operator at time of booking.

3. Booking Policy

These may be held briefly pending payment.

Confirmation

A booking is confirmed only upon receipt of a deposit or full payment and acceptance of these Terms. Bookings made within 45 days of the charter must be paid in full.

Right of Refusal

Ahoy Days reserves the right to decline bookings that breach these Terms or where Operator approval cannot be obtained.

4. Payment Terms

  • Deposit: Typically 50% of total charter fee, unless otherwise stated.
  • Final Payment: Due 45 days prior to charter date.
  • Payment Method: Credit or debit card accepted. Fees may apply.

Final guest numbers must be confirmed at least 14 days before the charter. Any increases require Operator approval; reductions are not permitted.

5. Cancellation Policy

By the Charterer

  • Deposits are non-refundable.
  • Bookings cancelled within 45 days are fully non-refundable.
  • At the Operator's discretion, food and beverage components may either be refunded or transferred as a credit.

By the Operator

  • If cancelled more than 45 days before the charter: Full refund of all monies paid.
  • If cancelled within 45 days: Ahoy Days will use reasonable efforts to arrange a substitute comparable yacht. If unsuccessful, a full refund will be issued.

Force Majeure

Unforeseen circumstances (e.g., government restrictions, natural disasters, pandemics) may qualify for a refund less any platform fees, or transfer to future charter credit.

6. Additional Charges

Any extras booked or used on the day—extended time, additional guests, late return, extras (e.g., water toys)—will be charged directly to the Charterer's payment method.

7. Responsible Service of Alcohol (RSA)

  • Operators must comply with RSA laws.
  • No alcohol to minors or visibly intoxicated persons.
  • Operators may refuse service at their discretion.
  • Sufficient food should accompany alcohol.
  • Unacceptable behaviour may result in charter termination without refund.

8. Security Bond

A refundable bond (amount detailed in your quote) may be required to cover damage or excessive clean-up. Refunds are processed within 7 business days after charter, less any deductions.

9. Vessel Substitution

If your booked vessel becomes unavailable (e.g., mechanical issues), Ahoy Days may substitute a comparable vessel at no additional cost.

10. Weather Conditions

Charters will proceed unless deemed by the Master of the vessel to be unsafe to go out. Poor weather alone is not grounds for cancellation or refund.

11. Navigation & Itinerary

The Master has sole discretion over route and operations to ensure safety. Pre-planned itineraries may be adjusted as needed.

12. Embarkation & Disembarkation

Arrivals and departures must occur within scheduled windows (typically 15 minutes each). Delays may incur additional charges.

13. Charterer's Responsibilities

  • The Charterer assumes full responsibility for the conduct of all guests aboard.
  • Any damage caused by the group is the Charterer's responsibility.

14. Damage & Liability

  • The Charterer is liable for any guest-caused damage, excluding normal wear and tear.
  • Ahoy Days' aggregate liability is capped at the fees paid for the charter.
  • Ahoy Days is not liable for indirect or consequential losses.
  • Claims must be lodged in writing within 7 days after the charter.

15. Indemnity

The Charterer indemnifies Ahoy Days and the Operator for losses arising from:

  • Ignoring safety instructions;
  • Unsafe or illegal conduct;
  • Damage or injury caused by guests.

16. Risk Acknowledgment

All participants engage at their own risk. Common risks include slipping, swimming incidents, or use of onboard equipment.

17. Swimming Policy

Swimming is permitted only when the vessel is stationary, during daylight hours, and at the discretion of the Master.

18. Governing Law

These Terms are governed by the laws of New South Wales, with disputes subject to the courts of NSW.

19. Acceptance

By confirming a charter, the Charterer acknowledges:

  • They have read, understand, and accept these Terms;
  • They must inform all guests of these Terms prior to embarkation.

20. User-Generated Content (Marketing Permissions)

By granting Ahoy Days use of your photos or videos, you confirm:

  • Ownership or lawful right to share;
  • A royalty‑free, non‑exclusive license worldwide;
  • Ahoy Days may edit or share content with attribution.

Permission can be revoked at any time via written request (affects only future use).
